Under the Fair Labor Standards Act, C and K Rentals was supposed to pay its employees - mainly gate guards and oil equipment cleaners - minimum wage and provide overtime pay for those hours over 40 worked in one week. The company leases oil drilling equipment to oil companies in south Texas.
Those in charge at C and K Rentals failed to keep accurate records of when employees worked, and investigators also discovered that the company was misclassifying employees as independent contractors when they should have been considered non-exempt.
