The New York Times reported that Fair Labor Standards Act violations resulted in Tyson Foods having to pay $32 million in back wages to more than 17,000 workers.
Workers from 41 plants and 12 states will be receiving the back wages after a federal district judge approved the settlement, ending a 12-year lawsuit. Tyson union representatives estimate that the employees will receive approximately $1,000 each.
The suit claimed that Tyson Foods failed to pay their employees for the time it took to put on and take off the protective gear that they were required to wear. Under the FLSA, non-exempt workers are entitled to compensation for all work that they do, even during the times right before they clock in or right after they clock out.
