Even state agencies like the Texas Department of Family and Protective Services' Child Protective Services Division in Austin must adhere to the U.S. Department of Labor's rules on minimum wage. The investigators are claiming that they were forced to work "off the clock" and that they were told not to record all of their hours, which is in direct violation of the Fair Labor Standards Act. The Texas Department of Family and Protective Services' Child Protective Services Division is also accused of not keeping proper working records on employees.
It also was found that the employees were not receiving the correct compensation for their hours worked over 40 from June 2008 until just recently. A similar case filed in 2000 caused the state to pay a settlement of $2 million.
