Restaurant Group in Kentucky Ordered to Pay Almost $115K in Back Wages

It has been determined that 43 employees working for a Kentucky restaurant group have not been paid the overtime that they earned, resulting in a decision by the U.S. Department of Labor to require the company to pay the employees over $114,000 in back wages.

According to NBC Channel 18 in Lexington, Kentucky, the Bluegrass Hospitality Group LLC failed to keep proper records of the hours its employees worked, which violates the Fair Labor Standards Act.

The Bluegrass Hospitality Group runs numerous restaurants in the Lexington area, and the company did not combine the hours that some employees worked while at different locations during the week. It proceeded to tell these employees that they were ineligible for overtime because they did not work more than 40 hours a week at one location.

The restaurants were also guilty of not allowing the employees to clock in until there were a certain number of guests in the establishment, even though the employees were performing work before they hit the time clock.
