A Texas unpaid wage claim was filed by tankerman Andrew Bryant after he failed to receive overtime for the 80+ hours he normally worked, according to the Southeast Texas Record.
Bryant is suing his employers, partners Enterprise Products Partners L.P. and American Commercial Lines LLC, since they had misclassified him as exempt from the Fair Labor Standards Act under the Seaman Exemption.
He has been working an average of 84 hours per week for the past three years with no overtime pay for his hours worked over 40. The tankerman was not performing the duties of a typical maritime worker for more than 20 percent of the time, which is why he felt that he should have never been exempt.
