Nearly $40,000 in Back Wages to Go to 23 Restaurant Workers for Wage Theft

According to TriCities News, a Department of Labor Investigation resulted in the repayment of back wages to 23 restaurant workers in Kingsport, Tennessee.

The parent company of two La Campina Mexican Grill restaurants, Atlas, Inc., was required to pay back $39,232 to the workers after it was discovered that they failed to keep proper record on the number of hours worked. The company was also found guilty of making tipped workers only work for tips, instead of also giving them an hourly wage, in order to avoid paying them overtime.

Atlas, Inc. also had to pay $4,301 in penalties, since this was the second time that they were caught violating the FLSA – the first was in 2008.

Some employees were working for more than 40 hours each week, but not receiving overtime pay, and others were paid a flat weekly rate that did not equate to an hourly wage of $7.25, the federal minimum wage.
