Houston Oil Drilling Company Ordered to Pay $137K to 139 Workers

Oil field workers employed by Oilfield Drilling Equipment & Rig Co. Inc. will be awarded $137,788 in back wages after a U.S. Department of Labor investigation found that the workers were incorrectly classified as independent contractors .

The misclassification caused 139 workers to be denied overtime pay, thus violating the Fair Labor Standards Act, which requires employees to be paid a rate of one and a half times their hourly rate for hours worked over 40 in one week.

The company, which does business as ODERCO Inc. in Houston, also should have been responsible for the taxes that the employees were required to pay as independent contractors, according to an article on Examiner.com. The article also reports that it is often low-wage and vulnerable workers who fall victim to the growing trend of employers misinforming their employees of their rights under the FLSA.
