$83,608 in back wages awarded to Amer. Airlines Federal Credit Union employees

According to the Examiner.com, 295 current and former tellers, loan officers, and customer service representatives will be receiving $83,608 in back wages from their employer, American Airlines Federal Credit Union in Fort Worth, Texas.

A U.S. Department of Labor investigation found that the Credit Union failed to keep proper record of the time that the employees worked, which is required under the Fair Labor Standards Act.

The discrepancy resulting in the underpayment stemmed from the bank misclassifying the workers as non-exempt. Instead of paying the employees straight time, American Airlines Federal Credit Union paid salary, which prevented the employees from receiving time and a half their hourly rate for the hours they worked over 40.

There are strict guidelines that employers must follow when classifying employees as exempt, and many times misclassifications occur because employers use job titles instead of actual tasks performed when determining overtime eligibility.
