A chain of Japanese restaurants must pay $144,721 in back wages to 66 employees, according to the San Gabriel Tribune.
Bishamon Group Restaurants runs several locations, and violations were found at all of them. Most commonly, dishwashers, prep cooks, and cooks were paid straight time for all hours worked, even though they were accumulating anywhere from five to ten hours of overtime each week. The Fair Labor Standards Act requires employers to pay their employees one and a half times the regular rate of pay for all hours over 40 worked in one week.
The restaurant owners also violated the FLSA by paying cash, without keeping proper payroll and time records. All of the employees were non-English speaking, as they all spoke Japanese or Spanish. The U.S Department of Labor believes that the incorrect payments were intentional, since the company made no efforts to hide the "peculiar" paper trail.
