According to Compensation Management News, miscalculations in overtime pay were the reason behind a Fair Labor Standards Act violation and the U.S. Department of Labor requirement that California-based Executive Plumbing pay back wages to more than 1,000 employees.
The company incorrectly paid plumbers on a piece-rate basis without properly factoring in bonuses when calculating overtime.
Piece-rate pay is allowed under the FLSA, but only if it is calculated correctly and overtime is paid. Workers who were with the company between January 2003 and January 2005 are affected.
