Take the Fair Wages Quiz for Houston Call Center Workers

In this touchy economy, most workers are willing to do anything to keep food on the table. For some people, this means being willing to take on a temporary job through a staffing agency. Many times, these temporary jobs involve working in a call center at all hours of the night.

But what happens when a temporary Houston call center worker is not treated fairly? Perhaps he is not receiving the overtime that he has earned, or his boss is not keeping track of all of his hours. Under the Fair Labor Standards Act, call center workers are entitled to overtime pay. And as we discussed in a previous article on this site, it is the job of the staffing agency to make sure that the FLSA is being followed – not the job of the temporary employer.

So what is a temporary call center employee in Houston to do if he feels that he is not receiving all of the wages that he has earned? According to the experienced Texas overtime attorneys at Kennedy and Hodges, the temp should take the following quiz to see if he has a base for his claim.

Give yourself one point for “Yes” answers and zero points for “No” answers.
  1. Does your temporary employer insist on paying you your paycheck directly instead of through the staffing agency?
  2. Are you forbidden to “clock in” until after your computer is booted up?
  3. Are you required to “clock out” and then shut down your station?
  4. Have you been asked to work through your lunch?
  5. Have you been told that your pay stops at the end of your shift, even if you still may be on a call?
  6. Were you told that you will not be receiving compensation until after you complete your training?
  7. Do you only get straight time for the hours over 40 you work in one week?
After adding up your one point for “Yes” answers and zero points for “No” answers, take a look at the following scales to see how you did.

0 points. Good for you. You are working at a job that appears to be completely compliant with the Fair Labor Standards Act, and you are most likely earning overtime pay.

1-2 points. Your temporary or staffing agency employer could be either making mistakes or dabbling in FLSA non-compliance. Either way, their behavior is causing you to lose money on your paycheck. Contact a Houston overtime attorney immediately to discuss your options.

3-7 points. Not only are you working for a company who appears to be completely non-compliant with the FLSA, but you are also entitled to a back wages claim. Contact an attorney immediately to set up a consultation.
