What is minimum wage?
Mississippi does not have any state minimum wage laws. This means the federal minimum wage of $7.25 per hour applies.

What is the minimum wage for tipped employees?
The federal law for tipped employees will generally apply in Mississippi, so minimum wage for tipped employees is $2.13 per hour. This is applicable as long as the tips employees receive plus their wage add up to at least minimum wage for hour worked. If it does not the employer must make up the difference.

When am I eligible to earn overtime?
Mississippi does not have any state overtime requirements. The federal Fair Labor Standards Act laws will generally apply to eligible employees. The federal wage and hour laws mandate that non-exempt employees are to be paid 1.5 times their regular rate when they work more than 40 hours in a workweek.

Am I entitled to a lunch or rest break?
Mississippi does not require employers to provide lunch or rest breaks. However, employees eligible to federal wage and hour protections must be paid for any interrupted meal or lunch breaks.
