Florida wage and hour laws

What is Florida minimum wage?
Minimum wage is $7.67 in Florida.

What is the minimum wage for tipped employees?

The hourly wage for most Florida tipped employees is $4.65 an hour, as long as the employee’s tips make up the difference between the hourly wage and the applicable minimum wage. If it does not the employer must make up the difference.

When am I eligible to earn overtime?

Florida has no state overtime law, so eligible employees are generally covered under the federal overtime requirements under the Fair Labor Standards Act, which mandates time-and-a-half pay for every hour over 40 worked in a workweek for non-exempt employees.

Am I entitled to a lunch or rest break?

Florida does not require employers to provide lunch or rest breaks. However, under the federal Fair Labor Standards Act, eligible, non-exempt employees are to be paid if they must work through their breaks.
