Arkansas
wage and hour laws

What is Arkansas minimum wage?
Arkansas minimum wage is $6.25 an hour, applicable to employers of 4 or more employees. Since Arkansas minimum wage is less than the federal minimum wage ($7.25 per hour) employees are eligible to receive the higher minimum wage of $7.25. Federal minimum wage overrides state minimum wage if the federal wage is higher.

What is the minimum wage for tipped employees?

In Arkansas, employers can pay tipped employees an hourly wage of $2.63, as long as the employee’s tips bring the total hourly wage up to the state minimum wage. If it does not the employer has to make up the difference.

When am I eligible to earn overtime?

There are exemptions under Arkansas law for certain employees, but eligible employees must receive overtime if they work more than 40 hours in a week.

Am I entitled to a lunch or rest break?

Arkansas does not require employers to provide lunch or rest breaks. Under the federal Fair Labor Standards Act, eligible, non-exempt employees are to be paid if they must work through their breaks and are generally eligible to be paid for any short breaks lasting five to 20 minutes.
