When is overtime pay due?

For covered, nonexempt employees, the Fair Labor Standards Act (FLSA) requires overtime pay at a rate of one and one-half times an employee's regular rate of pay after 40 hours of work in a workweek. Some exceptions apply under certain circumstances to employees in different industries, including workers employed by public agencies and hospital and nursing homes employees.

Some states also have their own overtime laws. If an employee is subject to both state and federal wage and hour laws, the higher standard of pay will apply.
