My employer has asked me to sign an independent contractor agreement but I feel that I am an employee. What rights do I have?

A:

Our firm has helped many clients who were required to sign independent contractor agreements prior to employment, but were later found to be regular employees under the law. If you are a non-exempt employee under the FLSA, you have rights under the federal wage and hour laws and these types of contracts usually are invalid, regardless of whether you signed it or not.

Thousands of employees nationwide are misclassified as independent contractors, and employers will use tactics like having employees sign independent contractor agreements in order to save money and deny workers their correct wages, including overtime pay.The truth is that nearly ninety percent of workers in the United States are actually employees, not independent contractors. A review of your job duties can determine whether or not you are truly an independent contractor.

If your employer treats you like an independent contractor, but you feel you have been working as an employee, contact our employment lawyers to review your case for free.
