If I am an independent contractor, do I lose my right to overtime pay?

Companies often incorrectly label their employees as "independent contractors" in order to avoid overtime pay.  Some companies do this mistakenly, others do it with full knowledge they are violating the law.  Either way, this misclassification often results in workers being substantially underpaid for their work. Sometimes this translates into thousands or tens of thousands of dollars in back pay owed.  

Let's be clear: the mere fact that your employer tells you and you agree that you are an independent contractor has absolutely nothing to do with your proper classification under the law. Instead the law examines what's called the "economic realities" of your job.
