A: No. Virtually all paralegals and legal assistants are eligible to overtime pay when they work more than 40 hours in a week. The one exception is when a paralegal holds some other advanced degree, such as an engineering degree. If that paralegal uses such engineering skills in his or her job as a paralegal, then an exempttion may apply for at least those weeks.
