I work in a clothing store and I frequently work off the clock but I am never paid for this time. Can I sue for back wages?

Under the Fair Labor Standards Act, employees are supposed to be compensated for all time spent working. This includes time spent

  • waiting on customers, 
  • working through meal breaks, or 
  • waiting in the store after hours for management to close up.
Many retail stores perform bag checks or keep employees in the store after hours, but never pay them for this time. Any time you spend working is considered compensable time under the FLSA and you should contact a wage and hour lawyer if you have not been properly compensated for all the time you put in at work.
