I work for an accounting firm as an associate and most of my work is clerical, but my boss said I am not eligible for overtime pay because of the administrative exemption. Is this true?

A: People often assume that because they work in a white-collar industry like banking, loans or mortgage that they are exempt from overtime pay. Our firm has represented many clients who work in the accounting and banking industry. The case is usually very similar – your boss classifies you as exempt under the administrative exemption, and tells you that means you are not eligible for overtime pay.
Don’t let your employer get away with this any longer - your job duties determine how you should be paid under the wage laws, not the industry you work in.
We have successfully represented bank associates, auditors and loan officers because most of their job duties were clerical and the exemption their employers tried to use simply didn’t apply to them.
