I work for a computer company but my employer claims I am not due overtime pay because of the "Computer Professional" exemption. Is this true?
A:
There is an exemption under the Fair Labor Standards Act for computer professionals. However, this exemption does not apply to all computer and IT workers. Just because you work with computers does not mean you are not eligible to receive overtime pay. Many computer professionals are led to believe they are not owed overtime because of this exemption, but this is simply not true.
Computer and IT workers frequently work much more than 40 hours a week and you could be owed back wages by your employer. Every case is different and you owe it to yourself to find out if you are owed money by your employer with a free case review.
