I am paid on commission, but my employer is not paying me the amounts due. Is this legal?

A: Commissions are normally paid to employees for successfully completing a sale, but many times employers do not pay their employees the commissions that are due to them.

Your bonuses, shift differential, commissions and/or other incentive pay should be included when calculating your overtime pay rate.

Our firm recently represented a sales representative who worked for a data integration company. The company was to pay him a base salary, plus commission payments. But at the time of payment, our client's employer refused to pay him for one of the commission payments he was owed. We successfully represented our client and proved that he did the work, made the sales, and was owed his commission payments.
