I am an IT worker - am I covered under the Fair Labor Standards Act?

A: You may be asking this question because you have heard of the Computer Professional Exemption under the Fair Labor Standards Act, or FLSA, which prevents some IT and computer workers from receiving overtime.

"Computer Professional" is a broad term, especially since there are so many different types of jobs that can (and some that cannot) fall into this category.

As a rule of thumb, if you spend more than 50% of your working hours troubleshooting problems with a computer network or computer hardware, addressing login issues or creating new accounts, or installing computer systems and software applications, then you may be entitled to overtime compensation and are therefore covered under the Fair Labor Standards Act.

Regardless if your title is "IT Professional" or "Website Administrator" - or anything in between - the best way to determine your eligibility for overtime under FLSA is to ask an experienced Houston, Texas fair wages lawyer and tell them about your situation.
