Warning Signs that You are a Misclassified Independent Graphic Designer in Houston

While graphic design can be a lucrative business to be in, depending on the company you work for, it is also a profession that is at a high risk for employer misclassification.

While some graphic designers are hired by a company to be an hourly-paid employee, others are hired on a project-to-project basis and are treated as independent contractors.

But even though the pay may seem fair, the risk for Houston graphic designers being misclassified still runs high, and can mean hundreds of dollars missing from paychecks.

There are certain warning signs that all independent graphic designers should be on the lookout for, to ensure that they are receiving all of the rights he or she is entitled to under the Fair Labor Standards Act.

Let’s take a look at what those warning signs are:
  • You previously worked as a graphic designer for your company on an hourly-basis, as a paid employee, and now your employer informs you that you are an independent contractor
  • Your independent contractor status came about after a busy time that required you to work overtime hours
  • Your boss requires you to arrive at a specific time each morning
  • You are responsible for overseeing some of the newer graphic designers in the company
  • You are required to take a lunch every day from noon to 1pm
  • If you were to leave the company, it would affect the business’ success
  • You must stay at the office until 5pm each evening
  • You are occasionally required to come in on weekends

All of the above scenarios are signals that you may be misclassified as an independently contracted graphic designer in Houston. For more information on how you can find out for sure, contact Kennedy Hodges at 888.449.2068 for a free consultation.
