Warehouse workers file FLSA suit against staffing agencies for alleged wage theft


Two staffing agencies are named in a lawsuit for allegations that they failed to meet Illinois wage and hour laws when paying employees. Eclipse Advantage Inc., and Mid-West Temp Group Inc. are both named in the Fair Labor Standards Act lawsuit. Wal-Mart is not named in the suit.

Workers promised minimum wage, bonuses.

The workers allege that they were hired by the staffing agencies to work in Wal-Mart warehouses in Elwood, Illinois, and were promised to be paid minimum wage, which is $8.25 an hour in Illinois, and given the ability to earn a bonus. Workers claim their paychecks told a different story.

In the lawsuit, workers claimed that their paychecks did not reflect all hours actually worked and as a result, their pay fell below minimum wage and they were not compensated for any overtime wages they were due. According to the lawsuit, when one of the workers asked for a copy of her time records the agency did not produce the records.

Temp agencies under Illinois state law.

In the suit, both temp agencies are accused of violating the Illinois Day and Temporary Services Act. Illinois requires agencies that place workers on a daily or temporary basis in manufacturing, construction and other non-clerical occupations to register with the Illinois Department of Labor (IDOL) and meet certain employment standards.

The suit was filed this month in federal court in the Northern District of Illinois on behalf of the warehouse employees.
