Technicians are rarely in one spot. Traveling from site to site to work on and repair machinery means that a lot of time is spent "off the clock." But the Houston fair overtime lawyers at Kennedy Hodges want to urge technicians to protect their paychecks by learning about when they are entitled to wages.
Under the Fair Labor Standards Act, technicians should be paid for travel to and from work sites, time spent at company meetings, and while on lunch breaks if they were still performing their duties. Technicians should also receive compensation for any time spent cleaning or preparing work vehicles, on-site or internet training, and even for work that was performed from home.
But as you can imagine, there are some employers who wrongly convince their techs that they are not entitled to pay during the above instances, which results in lack of overtime and therefore unfair wages.
What can a technician do to avoid facing these problems?
- - Document everything! Even though it is the employer's job under the FLSA to properly record the hours worked of every employee, technicians can help protect their paychecks by also keeping track of time. Writing down all hours worked, and briefly labeling what you were doing during that time can help you prove your case if you need to file a wage claim.
- - Keep your paystubs. Hanging on to these documents will allow you to compare the number of hours your employer thinks you worked to the numbers that you actually worked.
- - Talk to an experienced Houston fair wage lawyer. A lawyer can help you learn what your rights are under the Fair Labor Standards Act, as well as inform you of if and how your employer is violating them.
