T.J. Maxx Salaried shift supervisors may be owed overtime under Nevada's wage and hour laws.

Retailer T.J. Maxx sued for off-the-rack overtime pay practices - Salaried shift supervisors and managers may be owed overtime wages under Nevada's wage and hour laws.

T.J. Maxx owner sued for allegations of denying managers overtime pay.

T.J. Maxx's parent company, TJX Companies Inc., had $22 billion in revenue in 2010, but it seems warehouse shift supervisors didn't get their fair share of the pie for working overtime. T.J. Maxx is named in a wage and hour lawsuit by salaried supervisors who claim the retailer misclassified them under the labor laws so they did not receive overtime compensation.

TJX Companies Inc.is based in Framingham, Mass., and T.J. Maxx employs retail employees nationwide. These pay practices could affect thousands of employees. T.J. Maxx also operates Marshalls stores and HomeGoods outlets across the country. The employees who filed the wage lawsuit seek class-action status, meaning other workers in a similar situation could join.

What to do if you are a manager or supervisor not paid overtime?

Our firm has seen companies cheat shift supervisors and managers out of overtime by classifying them as management. Many employers try to use the administrative exemption to say that supervisors and managers are exempt from being paid overtime, but this usually doesn't hold up in court.
If you are a shift supervisor or manager your eligibility for overtime is determined by several factors, including:

  • Do you have discretion at work in making decisions?
  • Is your primary function manual labor or tasks similar to other employees?
  • Being paid a salary does not mean you are not eligible for overtime.

If you work over 40 hours a week and you are not paid overtime call our wage attorneys at 888-449-2068 or send us a confidential contact form to determine if you have been a victim of misclassification, wage scams or improper wage violations.
