Texas Tip Pooling Lawsuits

A bartender in Ohio is suing a former employer, Park Street Patio, because she said she and other employees were forced to share their tips with managers.  Since tips were pooled, the plaintiff claims, she and other workers did not receive the hourly minimum wage of $7.25 and she also claims that she did not receive compensation for overtime hours worked.

The lawsuit encompasses several bars including the Patio, Sugar Bar and The Social bar and lounge. According to court documents, over 100 bartenders and servers worked for the different locations, and the attorneys for the plaintiff are seeking class-action status.

Ohio law states that salaried employees, like managers, cannot share in pool tips. Employers can pay servers and others who receive tips $3.70 an hour, as long as pay with tips equals minimum wage.

Recently, pooled tip lawsuits have been filed nationwide against restaurants including the Hard Rock Cafe and Starbucks. In 2008, Starbucks was ordered to pay over $100 million to workers as a result of pooled tips with managers.
