Debris removal companies recruited workers from around Texas and Louisiana to work along the coast. A group of cleanup crew workers from Anahuac, Texas, is claiming that the company that hired them after the hurricane misclassified them as independent contractors and paid them "straight time" for hours worked over 40 in a week instead of overtime pay for all hours of their work.
The workers were employed by a debris cleanup company in Anahuac owned by Cecil Parker Jr., a former councilman and local contractor, who was awarded a $1.4 million public contract to help Chambers County residents recover from Hurricane Ike through debris removal and cleanup services.
The Department of Labor is offering a settlement for the workers of $105,000 for 57 Hurricane Ike cleanup workers. If you have been misclassified as an independent contractor, you need to order a free copy of our wage and overtime guide to find out why the Department of Labor can hurt your claim.
Misclassification as an independent contractor is all too common among many industries and our employment attorneys see these cases every day. Construction workers are especially at risk of being misclassified as independent contractors. Contact us today for a free case review.
