Temp workers and overtime pay under the FLSA: If you work for a staffing agency, don't be a victim of wage theft

Temp workers are eligible for overtime pay: If you work for a staffing agency, don't be a victim of wage theft

Temporary employees are sometimes called contractual, seasonal, or freelance workers. Many people also use the word "temps." Temporary work or temporary employment is a situation where the employee is expected to leave the employer within a certain period of time. The employer is paying for a service and can decide to stop that service at any time.

Many staffing agencies specialize in a particular field including industrial labor, accounting, health care, technical or secretarial. Temporary employees are sometimes caught in a constant state of employment uncertainty because they are never guaranteed consistent employment.

If you are a temp worker hired by a staffing agency, but are not paid your wages or your overtime pay, keep reading to see why you may be eligible for overtime pay.

Case in Point

A warehouse for Kraft Foods Inc. is facing a lawsuit over alleged unpaid wages by temporary workers. Workers hired by Atlanta-based temporary staffing agency Staffing Solutions Southeast Inc. for assignments at the warehouse filed a lawsuit in U.S. District Court in Chicago.

The workers claim that the company did not pay them for the hours they worked, for the minimum hours that they were contracted to work but weren't used, and for earned vacation time.
