800 Texas employees owed overtime pay - Austin CPS agents owed $1 million for overtime pay in Texas

Austin Child Protective Service agents owed $1 million in overtime pay; FLSA protections apply to private and public sector employees

If you work for a state agency you may be under the impression that you are not eligible for overtime wages or other FLSA rights. However, the federal employment laws protect private and public sector employees and provide them with employee rights to overtime pay, worker's comp and other rights.

Case in Point
A lawsuit has been filed against the Child Protective Services Division of the Texas Department of Family and Protective Services in Austin.

The suit claims 800 current and former CPS investigators and CPS case workers were denied overtime compensation and were also instructed not to record hours worked. The lawsuit seeks over $1 million in back wages for hundreds of child welfare employees the suit claims were not paid overtime wages.

The investigation included a three-year period from June 2008 to present after a complaint was filed in U.S. District Court of the Western District of Texas.

Overtime pay laws state that covered employees under the FLSA receive time-and-one-half their regular rate for working over 40 hours a week. The FLSA protects almost 90 percent of employees. Whether you work for a private or public company, there is a good chance you are eligible for FLSA protections.
