Senate states FLSA outdated: Wants new wage and hour updates for computer professionals.


FLSA updates for computer professionalsThe U.S. Senate has proposed legislation to update the Fair Labor Standards Act. The Senate concluded that the current law doesn't take the evolution of computers and technology into account. As a result, they want changes to the computer employee exemption.
In order to update the legislation, changes would create a more exact definition of who is a computer professional. The Computer Professionals Update (CPU) Act would affect FLSA protections, including salary requirements. Read on to find out what the changes are all about.
The bill would modify the computer employee exemption to apply to an employee:
  • Working as an analyst, programmer, engineer, designer, developer, administrator, or other similarly skilled worker.
Computer professionals: What are your primary duties?
Your daily tasks are important to determine your status under the wage and hour laws. If you work with computers, the changes would cover employees:
  • Working with systems, 
  • Working with networks or database analysis, 
  • Consulting with users, 
  • Designing and development, or
  • Directing or training individuals.
Hourly wage and salary requirements:
The recommended changes would require that computer employees be compensated at $27.63 an hour or be paid on a salary basis.
