Hundreds of Pfizer pharmaceutical sales reps in New York have joined a class action lawsuit demanding overtime pay and seeking class action status in New York, California and Illinois. Many of the employees were laid off following Pfizer's merger with Wyeth in 2009, which led to 20,000 layoffs. By the first few months of this year, hundreds of pharmaceutical sales reps have joined the case.

Pfizer is the biggest drug company in the U.S. and has the biggest workforce of any pharmaceutical company, employing around 110,000 employees. Around 8,000 of those employees are sales representatives. Except in certain areas, the Supreme Court has let stand rulings that require drug companies to pay overtime to sales reps who work over 40 hours a week.

Many sales reps are instructed not to record their hours for work duties performed off the clock, including:

  • required computer work,
  • administrative work outside of the office,
  • work done after field hours,
  • working nights weekends without pay.
