How the Texas Labor Laws Affect Licensed Nurses; Texas Licensed Nurses can Refuse to Work Mandatory Overtime

Over 66% of nurses are working some form of mandatory or unplanned overtime each month, according to a survey by the American Nursing Association. The link between fatigue and errors in the workplace can severely affect workers, especially in the hospital industry. Licensed nurses in Texas are covered by certain labor laws that apply to overtime requirements.

Many states have mandatory overtime restrictions for hospitals, including California, Connecticut, Illinois, Maryland, Minnesota, New Hampshire, New Jersey, New York, and other states. But Texas hospitals cannot, with some exceptions, require licensed nurses to work mandatory overtime.

Nurses in Texas are authorized to refuse to work mandatory overtime and hospitals cannot suspend, terminate or discriminate against nurses who refuse to work mandatory overtime.

If you are a nurse paid on a salary you may be entitled to receive overtime. In fact, most nurses are entitled to overtime pay. If you are a type of nurse, such as a registered nurse (RN) or a licensed practical nurse (LPN) who is paid on an hourly basis, the chances are very likely that you are eligible to receive overtime pay.
