Nurses and healthcare professionals in Texas are frequently deprived of the wages to which they are lawfully entitled. They are required to work long hours through lunches and breaks and even off the clock. Many of them are "on call" through the evening and on weekends, leaving them little or no time to enjoy their lives outside of work.

Case in Point
Gentiva, the country's largest home health care service provider, is accused of misclassifying nurses and clinicians in a conditionally certified nationwide class action lawsuit. The lawsuit claims Gentiva did not pay the health care workers for all hours worked and misclassified many of them as exempt from overtime pay.

The workers were paid on a "per visit" basis for some work and a "unit" rate for other work, but the lawsuits claims that those rates are based on time estimates. As a result, the lawsuit claims these employees are not exempt under the FLSA ruled for professionals and are due overtime.

It is estimated that more than 10,000 current and former nurses and other health care workers will have the opportunity to join the overtime class action lawsuit to make a claim for unpaid wages.

The FLSA enacts civil and criminal penalties for employers who take any form of retaliation against any employee who exercises his or her right to demand fair wages under the FLSA and state labor laws.
