Hershey's workers scared the candy company this Halloween month when twelve current and former employees filed another wage lawsuit. Hershey Retail Sales Representatives (RSR) filed a Fair Labor Standards Act (FLSA) lawsuit for unpaid overtime in California. Hershey's sued twice for unpaid overtime claims In February, a federal judge in San Francisco ruled that Hershey violated federal and California overtime laws by misclassifying the RSRs as salespersons and administrative employees and not paying them overtime. It seems Hershey didn't learn their lesson the first time because pay practices for the sales representatives haven't changed since the first lawsuit was filed in February.
