Another hotel on the strip was served with a wage and overtime lawsuit recently. This time it’s the Cosmopolitan of Las Vegas. The lawsuit was filed by a former employee who claims the casino did not pay hourly employees for all hours worked and also allegedly did not pay proper overtime rates required under the Fair Labor Standards Act.
Cosmopolitan’s time-keeping system shaved off worker’s hours
Among the allegations, workers claim that the Cosmopolitan’s time-keeping system rounded work hours based on 15-minutes intervals, so employees that clocked out four times could lose an hour per day deducted from their pay.
Workers also claim the hotel shorted them on overtime pay in several ways, including:
- Workers were paid part of room service gratuities, but the hotel allegedly did not include the bonuses or commission payments in employee’s overtime rates;
- Workers were not paid for time spent changing into and out of hotel uniforms, also known as donning and doffing.

Hotel workers often shorted on hours, pay
If you are an hourly, non-exempt hotel worker you should be paid at least minimum wage and your correct overtime rate (one and one-half times your regular rate) if you work more than 40 hours a week.
