Learn How to Protect Your Rights as a Temporary Worker in Houston

Many people turn to staffing agencies if they have been unsuccessful in finding full time employment. In the struggling economy, the job market can be sparse, and if you finally land a job, it can mean that you are adamant on keeping it, even if it is just temporary.

If you are a Houston temporary worker not receiving overtime, the fear of losing a temporary job may cause you to ignore the fact that you are being treated unfairly under the Fair Labor Standards Act, or just choose not to question the treatment, even if it does not seem right.

Unpaid overtime and unfair wages that do not meet the federal minimum wage standards are two of the most common ways that temporary workers are treated unfairly under the FLSA.

But the Houston overtime lawyers at Kennedy Hodges urge those employed by a staffing agency to use the following tips to protect their rights and paychecks.

  • Understand that the staffing agency is responsible for FLSA compliance. If your temporary employer is telling you that you cannot receive overtime pay, address it with the agency.
  • Establish your FLSA status before signing an employment contract. Talk to the agency and make sure that you are both on the same page when it comes to exemption or non-exemption under the FLSA.
  • Keep track of your hours. Part of your employer’s duties is to keep proper record of the number of hours their employees work, which can be hard if you are employed by the staffing agency but working at the location of the temporary employer. Keeping track can help you avoid any discrepancies later.
  • Communicate to make sure that that what the temporary employer is reporting to the staffing agency is accurate. Truth about the number of hours worked, performance ratings, and any other pertinent discussions can make a difference in you finding full-time employment and also making the most of your paycheck. Having frequent discussions can help facilitate accuracies.
