Just Brakes can't put a stop to our employment lawyer's investigation into their wage and hour practices.
Bizarre bonus and commission calculations surround allegations of unpaid overtime.
If your company's commission and bonus calculations confuse you, you're not alone. Our firm is investigating pay practices at Just Brakes for allegations that our client received incorrect overtime payments because of Just Brakes' pay practices.
Bonus and commission payments should be included in your overtime pay.
Federal law mandates that employers must take into account all work-related payments for both hourly and salaried employees. This means that bonuses or commission payments must be added to your total wages to determine your correct regular rate of pay, which affects your overtime rate.
If a company fails to do so it is a violation of federal wage and hour laws and employees could lose a significant amount of money every month.
Why you can't trust your employer to pay you correctly.
Our client, an assistant manager, claims that Just Brakes (Brake Centers of the Southwest, Inc.), paid him an hourly rate and overtime pay, but they failed to include his commissions and bonus payments in the overtime calculation. The law provides that when less than 50% of your pay comes from commissions, the employer must include such compensation in the overtime calculations. Most non-discretionary bonuses must also be included in calculating the overtime rate. Our client claims that by excluding these payments, his overtime rate was diluted. He believes this practice is widespread and applies to all assistant mangers across the country.
We are also investigating claims on behalf of Just Brakes mechanics and technicians who claim that they were required to work off the clock without pay.
