Many large retail stores have already faced lawsuits over this issue. One class action overtime wage claim in California, which involved 2,000 janitors (many of them undocumented workers), included employees who worked seven days a week without receiving overtime pay, were hired by janitorial subcontractors, and were employed by large grocery store chains including Safeway and Albertson's.
Case in Point
A group of employees has filed a class-action lawsuit against their employer, which provides janitorial services at JCPenny stores in New York and New Jersey. The lawsuit alleges that the company has not paid them overtime.
Janitors at the cleaning firm claim that the company often required employees to work more than 40 hours a week, but did not pay them overtime or for all hours worked.
The lawsuit seeks back pay for all hours between 2003 and 2008 at 157 locations. The collective action included over 100 employees.
A U.S. District Judge preliminarily certified the lawsuit as a class action. The lawsuit seeks damages equal to the back wages, plus attorneys fees and costs.
