Lawn care service companies promise to take care of all your lawn labor and turn your turf into a green masterpiece. But there's one type of green that one of these companies failed to take care of and that's the paper type.
Lawn care specialists normally work every week doing lawn applications at job sites. Job duties can include mixing chemicals, applying lawn treatments, various office jobs, and more. The pay structure can consist of a base salary plus commissions. Many companies also may use the fluctuating workweek pay method, but can make mistakes applying it - this can lead to federal wage violations.
Case in Point
TruGreen investigated for unfair overtime pay practices
Our firm is currently investigating TruGreen Inc., a lawn care maintenance company based in Tennessee, for claims that the company used the fluctuating workweek pay practice to pay employees overtime, but used the method incorrectly. This is a wage and hour violation under the Fair Labor Standards Act.
Even though he worked more than 40 hours a week, a lawn care technician claims that TruGreen did not compensate him with one-and-one-half times his regular rate for his overtime hours. If you are a non-exempt employee this is a violation of federal law.
