By paying employees with the "fluctuating workweek", inspection company allegedly failed to pay minimum wage and overtime.Kennedy Hodges, LLP, filed a minimum wage and overtime lawsuit today against an Inspection service company called Intertek USA Inc.
Overtime violations for inspectors - The Fluctuating Workweek
Intertek USA employs inspectors nationwide to provide laboratory testing, cargo inspection and certification services. The lawsuit claims that Intertek permitted its inspectors to work over 40 hours per week, but did not compensate them at a rate of one-and-one-half times their regular rate of pay for all hours over 40.
The suit also explains that the company's use of a "fluctuating work week" pay method resulted in a reduced overtime payment to our clients and a minimum wage violation.
