As Houston fair wage lawyers, we at Kennedy Hodges recognize that there are a lot of great unpaid internship opportunities out there and that in order for a student to gain necessary experience in a certain field, it isn't always necessary to receive a paycheck.
But what we do want to make students aware of is that an internship should be all about your education with the help of the company - not doing free work to benefit the employer.
Because of this, we have come up with the following list of questions. Check them out if you are currently working as an unpaid intern or debating whether or not to become one.
1. What will my specific tasks be?
2. Will I be working alone or under the close supervision of an existing employee?
3. Can my job be done by a regular, paid employee?
4. Am I bringing in revenue for the company but not being rewarded a cut of that money?
5. Does my being with the company help business operations or is the company making a sacrifice to have me there?
6. Is my training the same or similar to training I could be receiving at school?
As Houston unpaid internship attorneys, we want students to ask themselves these questions because under the Fair Labor Standards Act, students are entitled to minimum wage compensation if the work they are doing is too closely related to that of a normal employee.
If you feel that you are more of an unpaid employee than an unpaid intern, contact Kennedy Hodges at 888.449.2068 today for your free consultation. We also can provide you with a free copy of our book, Ten Biggest Mistakes That Can Hurt Your Wage and Overtime Claim, which discusses issues like fair pay and overtime compensation.
