How to make sure your paycheck reflects Daylight Savings Time

Daylight Savings Time and your paycheckDid your employer deduct that extra hour of work?

Daylight Savings Time has ended, forcing us to roll our clocks back. Most people will get an extra hour for our favorite activities, but some of us will get an extra hour of work. If you clock in for a graveyard shift you might wonder if your boss is required to pay you for that extra 60 minutes. Luckily, the answer to that question is straightforward.

How does the time change affect your paycheck?
The Department of Labor (DOL) has regulations specifically covering Daylight Savings Time. If you are on the clock when the time is set back then you have to work that last hour twice. So what does the Fair Labor Standards Act say about your pay?

Graveyard shift workers
As an example, the DOL states that if you have a shift from 11 p.m. to 7:30 a.m., then when "...Daylight Savings Time ends at 2:00 a.m., the employee works the hour from 1:00 a.m. to 2:00 a.m. twice because at 2:00 a.m. all of the clocks are turned back to 1:00 a.m."

As a result, you've worked 9 hours instead of eight, and that extra hour is compensable. The Fair Labor Standards Act requires your employer to pay you for all hours worked. If your boss tells you otherwise, there may be other shady pay practices at hand.

What you can do about unfair pay practices
