  • record the actual time you respond to the call, pager, or other interruption.
The more you are interrupted outside of your normal work schedule the greater the chances are this time is compensable. The time between the interruptions might not be compensable, but the time actually interrupted is almost always compensable.

Two Texas refinery employees sued their former employer claiming they were not paid correct overtime. The oil and gas employees claim that:

  • they were required to work more than 40 hours a week without seeing a dime for overtime pay, and 
  • they were sometimes required to be on call 24 hours a day without any compensation for this time.
