Health care workers under new wage laws

Health Care Workers May Benefit From New Wage and Overtime Laws
The Department of Labor is set to propose new rules to bring more home healthcare workersunder federal minimum wage and overtime standards.
Congress exempted certain home healthcare employees in 1974 from the federal minimum wage and overtime pay, specifically those considered "companions for the aged and the infirm." The rules have remained largely unchanged since. The U.S. Department of Labor followed Congress' decision by writing rules to specify who would be affected under the new law.
Even though this proposed change may seem unappealing to home healthcare companies, the Wage and Hour division of the Department of Labor is taking into consideration the changes in this job sector that change the rules.
Many nurses work more than 40 hours a weekand frequently do not have an uninterrupted lunch break.  Certain types of nurses are not exempt under the FLSA.  Read our Nurses & Healthcare Workers page to read more.
