The owners of several Estela's Mexican Restaurants in Florida failed to pay Florida employees overtime compensation and owe double damages to employees under the wage laws.

The restaurant employees at Estela's Mexican Restaurants work well over 40 hours a week waiting tables, bussing, cooking, and washing dishes. When they finally clocked out at night they probably had no idea that the restaurant owners owed them thousands of dollars in overtime pay.

73 dishwashers, bussers and cooks may be owed as much as $6,500 each after working in four Estela's restaurant locations in Florida without overtime pay: South Tampa, Brandon, Davis Islands and New Port Richey.

Owners at the 4 Estela's Mexican restaurant locations owe $275,000 in back wages and damages to these restaurant employees in South Tampa, Brandon, Davis Islands and New Port Richey. Department of Labor investigators say the restaurant did not pay workers overtime or proper wages, and meanwhile Estela's restaurants had $3.75 million yearly revenue.

Liquidated damages means punishment for employers

After owners failed to respond to federal court about the wage lawsuit, a judgment was ordered against the restaurant, meaning they have no choice but to pay up. The Department of Labor spokesman said that "If the employer would have agreed at the start to repay workers that probably would have only cost them $137,000."

A co-owner of Estela's Mexican restaurant said that the Department of Labor investigation was a "witch-hunt," but this isn't the first time Estela's restaurant has been found violating labor laws: In 2003, Estela's Mexican Restaurant owed $24,517 to 38 workers for overtime wages.
