Does the FLSA protect babysitters? Learn how the FLSA protects domestic service workers.

Many full-time baby-sitters, or domestic service workers, carry out many different tasks in a day. Housekeeping, traveling, and other tasks can take more than 40 hours a week. The wage laws for employees in this industry do cover many workers, including:
  • day workers,
  • housekeepers, 
  • chauffeurs, 
  • cooks, or
  • full time babysitters.

Domestic service workers can include housekeepers, full-time babysitters, and cooks and many times they are covered by the federal wage and hour law. Many live-in domestic workers fall under different labor law regulations.

The FLSA rules for domestic service workers can get complex. If you are unsure whether you are owed overtime pay, or if something just does not add up on your paycheck, contact an experienced employment lawyer to determine the facts of your case.

Just because you are not paid overtime by your employer does not mean you are not eligible for it. Do not assume your employer knows the employment laws. Many employers intentionally misclassify workers and rob them of thousands of dollars in wages each year.
