Case in Point - Sutherland Global Services, a New York company, got a rude awakening in 2005. That's when two call center telemarketers from Rochester filed a wage and overtime lawsuit against the company.

The two employees claimed they worked more than 40 hours a week, but Sutherland never paid their proper overtime rate required by the Fair Labor Standards Act.

Originally, the wage and hour lawsuit was filed on behalf of only the two employees. But after some investigation the lawsuit grew to include 10 employees. In the end, 1,800 workers joined the lawsuit against Sutherland.

Judge approves $4 million dollar settlement for workers

Last month, a district judge approved a $4 million settlement, officially closing the case after it was opened in 2005.

The legal expenses totaled $1.3 million (28% of the settlement). The judge said the expenses were "reasonable in light of the effort expended and risk taken by class counsel."
