Desktop support technicians file wage lawsuit against law firm for overtime pay

Desktop support technicians are responsible for installing, maintaining and troubleshooting office software and hardware. Employers often try to misclassify computer technicians under the "computer professional exemption," or, in this case, they try to get away with giving employees comp time off instead of overtime pay.

Under the FLSA, non-exempt employees are to be compensated with their time-and-a-half rate, not extra time off.

Case in Point

A former computer support technician of a Manhattan law firm, Schulte Roth & Zabel, filed an overtime lawsuit against the company on Monday in Manhattan federal court. The lawsuit claims that the law firm violated the Fair Labor Standards Act by substituting extra time off for overtime pay.

The lawsuit claims that Schulte Roth's policy for overtime gave technicians extra time off to compensate for every hour they worked beyond the standard 40-hour work week, instead of offering them overtime pay.

The lawsuit was filed on behalf of seven employees who also worked as desktop-support technicians for Schulte Roth in the past three years.

The lawsuit seeks class-action status and the support technicians seek to be compensated for all unpaid overtime wages, including interest and penalties under the FLSA.

Schulte Roth has offices in New York, Washington, and London specializes in legal matters involving the financial-services sector, including investment management, corporate and transactional matters.
